Constitution Day 2017 "Executive Power under a Broken Constitution: Interpreting Trump's Presidential Authority" A talk presented by Mark Graber.

Many commentators insist that constitutional authorities must not bend the constitution in any way in response to a president who lacks every qualification for that office other than being elected consistently with the rules in Article II. Other enterprises respond differently to breakdowns. Actors and athletes improvise when events undermine original plans; the same should be true of presidential power. This paper defends adjusting presidential power to presidential capacity, and discusses various techniques for limiting presidential power in such circumstances.

Mark Graber, University System of Maryland Regents Professor, Francis King Carey School of Law, University of Maryland Mark Graber is a leading scholar of constitutional law and politics and author of many pathbreaking books and articles including Dred Scott and the Problem of Constitutional Evil (Cambridge UP, 2006) and A New Introduction to American Constitutionalism (Oxford, 2013). He is co-editor (with Keith Whittington and Howard Gillman) of American Constitutionalism: Structures and Powers and American Constitutionalism: Rights and Powers, both also from Oxford University Press. He is presently working on Forged in Failure, a book that will examine how much constitutional change in the United States has been caused by the failure of constitutional practices to function as expected. Mark received his Ph.D. in Political Science from Yale, and his J.D. from Columbia University Law School.
